3:40 - 4:30 PM - Cybersecurity and the Courts: An Update and Guide to Navigating the New Litigation Paradigm Presented by Charles River Associates

Cyber Litigation is changing rapidly as a result of new, large, and high profile data breaches (as a survey of the leading cases will show), increased attention from US regulators, and new regulation in Europe.  One result may be more shareholder derivative actions at the same time that data breach class actions and regulatory enforcement multiply.  Business-to-business litigation could also increase, requiring a sharper focus on partner and vendor contract terms.  Insurance coverage gaps and disputes will also come into play.  Inside counsel will need to learn to manage all of these aspects of the new Cyber Litigation landscape to stay ahead.

This session will cover the cyber security and data protection issues in contracting and how to address them by developing critical contract playbook components, triaging/routing in your contract management function and developing useful data analytics. The contract playbook elements under discussion include: developing a dynamic clause library, critical clauses, and position articulation. The data analytics elements we will cover include what information/data should you extract from your contracts and best practices for reporting on them.

Learn the basics of electronic signatures, electronic vaulting and practical tips for setting up and using this technology.  We will also discuss enforcing electronically signed documents and how a properly created e-signature process can also reduce the risk of fraud.
