This session will cover the Foreign Corrupt Practices Act (FCPA) and other anti-bribery laws, with a focus on recent FCPA enforcement trends.  The goal of the session is to provide practical guidance to in-house counsel regarding how to resolve FCPA investigations and how to design compliance programs that spot potential FCPA problems early and address them effectively.  The session will also include discussion of the increasingly coordinated international enforcement of anti-bribery laws, an important consideration for in-house counsel supporting multinational businesses.

This session will apply lessons learned in the prior panel to a hypothetical case study of FCPA violations in the United States, Brazil, and the UK.  The goal of the session is to address practical issues from the moment an in-house counsel becomes aware of a potential FCPA or local anti-bribery law violation all the way through to resolution with regulators and law enforcement.  The session will also include discussion of data privacy and employment law considerations; managing data in multiple jurisdictions; maintaining the attorney-client privilege; negotiating penalties across jurisdictions and more.

Can a company post a photo of a celebrity using its product to social media? Can a company repost content found on social media?
