2020 has been a transformative year in employment law. For many, our homes are now our workplaces. This change brings with it never-before contemplated social and legal challenges for employers. Trends are beginning to emerge. We can now begin to foresee how the work-from-home environment will result in workplace claims that do not fit squarely into traditional models. Anticipating these threats allows us to provide insight into how both to avoid and respond to them. Areas we will explore include: (a) the current and developing landscape for employers, employees and the plaintiffs' bar; (b) "remote" harassment and discrimination issues (with emphasis on sexual harassment, age discrimination and disability discrimination); (c) misuse and abuse of leave laws; (d) wage and hour violations and (e) restrictive covenants.
