This program will explore the new rules about lobbying in New York with former Special Counsel to the Governor, and the former Executive Director and former Commissioner of the NYS Joint Commission on Public Ethics, the agency charged with monitoring lobbying in state. They will discuss when you cross the line into lobbying and when you need to start reporting your lobbying activity. This includes activity by a consultant, a trade association, a PR firm, or the public (e.g. a call to action). The panel will also discuss the implications if you cross the threshold into lobbying—including bans on gifts to public officials, charities, and other third parties, limitations on use of former government officials, disclosure, registration, and potentially penalties if noncompliant—and the ethical obligations lawyers incur when they unwittingly (or knowingly) cross the line and become lobbyists. The program will end by offering best practices and suggested internal controls.
